A Study Of The U. S. Consular Protection Practice In Yunnan Province Of China

With the rising of international exchanges among different nationals, the demand for consular protection worldwide continued to increase. Then, articles on this research published in succession. As a comparatively mature mechanism, U.S.consular protection led this field as it started earlier. Based in Yunnan Province, this article studied the practices of U. S. consular protection mechanisms carried out by the U.S. consular posts to China from several practical examples which took place in recent years.Through the methods of comparison studies, case studies and literature studies, the U. S. consular protection mechanism showed its characteristics as follows:it focused on the information gathering and judgement of the overseas situation and citizens at a practical level; it developed a strict and detailed rules and regulations that clearly defined the rights of performer and protectors at the institutional level; at the psychological level, starting from their own cultural values, it put protecting the personal safety of citizens abroad as a basic point, reflected its respect for each individual. The case studies showed that the U. S. consular protection mechanism, multiplied with humanistic ideas, concerned for individual citizens and a sense of responsibility of policy makers while it ran in strict accordance with rules. Thus, it added to the theoretical mechanisms treasure and enriched the overall framework of the mechanism, and formed a relatively complete system. Meanwhile, in lots of cases, the implementation of consular protection will inevitably occur and more or less linked with the host local government, so the interaction between the two parties has direct impact on the effect of consular protection.With the rising of various emergencies and accidents chance in China, Emergency Response Management involving Foreign Nationals has been an indispensable part of the overall Emergency Management System. In the disposal process, the cooperation of foreign consular posts to China is an important way to solve the problem properly. Therefore, after extracted the characteristics and essence and referred to certain proven effective practices of U. S. consular protection mechanism, the article returned to Emergency Response Management involving Foreign Nationals of Yunnan Province with some ideas and recommendations.
