Nowadays, the population aging has gradually become a worldwide issue. With theaging population growing, many countries are improving laws in an attempt to betterprotect the rights of this part of the population. Therefore elderly care has become animportant topic. In China, with the development of the economic, social production andliving mode has occurred has undergone enormous changes. The change of familystructure and traditional pension culture makes China’s existing laws and regulations toprotect the rights of the elderly not comprehensive and perfect. Therefore, in the newcontext of the times, how to better protect the rights of the elderly, especiallyguardianship, is an important task.This article covered the development and principle of adult guardianship andcontrasted the existing laws and regulations in other countries. From there, we canunderstand how the guardianship system is constantly developed and how does theguardianship system give older people more freedom as to form a contract arrangementsin later life. Therefore the contract as an important part of the guardianship of conductsystem should be emphasis on.Then we discussed the particularity and commonality ofsuch contracts in order to understand the overall system. We then illustrated the specialnature of the rights and obligations in this contract. Finally we discussed how to protectthe system from the supervision. A more comprehensive analysis of the guardianship ofconduct’s contract can help better understand the significance and particularity of theguardianship system so as to improve the elderly guardianship.
