Water West Yi Customary Law Marriage

The customs of marriages among ethnic minorities in our country are varied in content with profound ideas, which constitute the most important part of marriage and family history in our country. Given the vitality of the ehinic marriages, the thesis discusses the relationship between Yi people’s marriage custom and national law to reflect the implimentation of National Marriage Law in Shuixi Yi areas in light of the chages of marriage customs under the condition of the economic changes.The main body consists of three parts:(1) the basic section:to make an accurate description of marriage custom in Shuixi area (2)to make an analysis of Shuixi Yi marriage custom under the framework of law from aspects of the conflicts and co-relation within those elements(3) to draw solutions to those results of the law analysis.Specifically speaking, this paper mainly has four parts. The first part presents an introduction to procedures of Shuithe Yi’s marriage,including process of acting as matchmaker, engagement, pledging engagement and the process of getting married; the paper analyzes the problems in the process one by one. The second part makes an analysis of divorce and its problems are analyzed, including divorce, property allocation and the upbringing of children.The third part analyzed remarriage and the causes. The fourth part discusses the possibility of moderating customary law and national law on the basis of a fully analyzed the relationship between the customary law and national law and implemetation of national law. Meanwhile, the author proposes the concrete countermeasures and Suggestions.The first is to enhance the promotion of legal knowledge; Second is to popularize law with the help of the religious people; The third is to value authority in Yi village; The last is to reform marriage customs.The thesis aims to present the valuable spiritual heritage to the whole world to provide a comprehensive understanding of marriage, family and law of Yi people, which can benefit the construction of marriage and family law system in the minority areas.
