Legal Issues Of International Factoring

International factoring is also called the international factoring, factoring exportaccounts receivable business, is a new kind of trade settlement methods developed inrecent ten or twenty years. In the international trade in different countries or regions oncredit sale of goods or services offered by both parties to the transaction, the supplier willbe generated with the debtor signed a contract for the sale of goods or service contract ofassignment of receivables to factoring, and by factoring business to the supplier to providetrade financing, sales of household account management, should be a comprehensivefinancial business receivable collection and guarantee services.In view of the international factoring has many advantages, it has become themainstream mode of payment in international trade. But in China, the internationalfactoring is a kind of financial innovation service. The legal norms and the lack of lag,seriously restricted the development of factoring. The law establishing and perfecting thefactoring legal system, study and solve problems in international factoring business,become a pressing matter of the moment.The current research on international factoring is limited to international factoringpractice, foreign related international factoring practice and theory, the relevantinternational conventions and other categories of international factoring. There is littleresearch on it from the angle of law. So the paper from the perspective of the legalperspective, this thesis summarizes the concept of international factoring, the first part ofthe characteristics, functions, mode of operation; the second part further clarifies the legalmechanism of international factoring operation, clear the situation of the rights andobligations of the parties; in the third part, based on in-depth study of China’s internationalfactoring legislation and international factoring business operation status, in-depthanalysis of the main problems existing in international factoring in our country; the fourth part on the basis of the above proposed the establishment and improvement of legalsystem of international factoring in our country.
