Relevant law study on sea water desalination issues discuss the topic about sea areaservitude, and how could people guide sea water desalination into the law system. Seawater desalination refers to any of several processes that remove some amount of salt andother minerals from sea water, it seems obviously that it belongs to sea area servitude.However the fact is on the contrary, whether in the theory or in the law system. In thetheory of law, it is not seen the research of sea water about character, the characteristic ofobject, the derivative, or the controlling of sea area servitude. It leads to the situation thatthe sea area servitude system include the related behaviors of using sea water out.The first chapter introduces the regulations and studies about the sea area servitudeand its relations with other similar sufructuary rights. The second chapter studies in thecomplexity of using sea area, and the solidness and the economy of the object of sea area,are the factors which cause the resolution of the object. The derivative of the right, causesthe dissolve of the right, including the right to obtain sea water and the right to develop thesea area. The control of the sea area and the ocean resources is not satisfactory that the seaarea servitude is different from land tenure, the mining right, the fishing right and the rightto obtain water resource.The last chapter includes my thoughts about the relationship between sea areaservitude and sea water desalination. Water desalination is not only in accordance with theright to obtain sea water, but also consist of one of the maintain value of sea area servitude.The character of sea area servitude makes it theoretical possible for the sea waterdesalination to enter the law system.
