Thesituation of big population with little land, the scarcity of the per capita occupancy of landresource, which is Chinese basic national conditions, also require urgently that we must doa good job in the rational use of land, and use market mechanisms for rational allocationof land resources, give full play to land performance. As an important part of land marketsystem, land circulation system, especially the rural collective construction land use righttransfer mechanism, which has great practical significance to deeply research. Ruralcollective construction land use rights transfer system is currently faced with the plight ofthe legislative restrictions and lag. The lack of the legal system let rural residents can notlegally obtain the corresponding property of the dominant position to share the fruits ofsocial development. And the old framework of legal system has been unable to meet theeconomic development needs for the collective construction land.
