On The Criminal Protection Of Personal Information

In information society, we enjoy the convenient and shortcut which is brought bythe information sharing. However, in the welfare of information society, we have toface the huge threat to personal information by illegal violating. When anyone wouldnot be excluded from the welfare of information society, we should also realizeclearly that everyone is in the huge threat of personal information by illegal violating.Based on criminal field, this paper discusses the protection of citizens’ personalinformation in order to consummate the protection of citizens’ personal information inour country criminal law and make suggestions for establishing the system ofprotection for citizens’ personal information in the law. In order to sort out thedifferences of citizens’ personal information protection between the different method,firstly, this article has analyzed the necessity and value basis of citizens’ personalinformation protection by the concept of personal information in the section betweencriminal law and civil law, and based on the difference between the civil law countriesand common law countries in the personal information reorganization.Under this scale, the paper put forward the deficiency of citizens’ personalinformation protection system and the specific crime in our country combining withthe judicial practice of China with the theory of crime constitution.In the last part, this paper gave consummate ways for the front law legislationand the specific crime in citizens’ personal information protection from our judicialreality by the general legislation theory.
