Study On Civil Law Protection Of Network Privacy Issues In China

In twenty-first Century, the importance of the Internet is self-evident andInternet has become a very important part in people’s life. Its convenience makes itmore and more popular. Although it provides many benefits to people’s life, alsobrings the hitherto unknown challenge to the protection of privacy. Internet users areimportant driving forces of the network technology development and transformation,also the subject of a variety of network transactions, and only to protect the networkprivacy right, to remove their personal information exposure concerns, so that thenetwork transactions can be carried out smoothly, the network can be healthy andorderly development. Therefore, the network is no longer “a piece of pure land fromlaw”, it must be regulated by law.At present, privacy legislation is not perfect in China, the protection of privacyon the Internet research, and its legislation, judicial practice are more lagging.Therefore, on the background of accelerating into the network era, it is a pressingmatter to establish the civil law protection system of network right of privacy.The paper will give a brief analysis of legal concepts of privacy on the Internetfrom the angle of civil law, and point out the differences and connection between theright of network privacy and traditional right of privacy, finding network privacy’sparticularity, based on this, this paper will analysis the network privacy tort behavior;and how to apply the imputation principles of the tort of Internet privacy, then thenetwork privacy tort elements will be discussed; and after that, the Internet privacyright protection system of the main countries in the world will be introduced, citingtwo typical models as examples, and the advantages and disadvantages of them willbe further analyzed. Through the elaboration of the status and existing problemsabout our network privacy protection by civil law, the paper will then put forwardproposals in term of our network privacy protection of civil law.
