Research On Property Relationship Of Unmarried Cohabitation Legal System

As a sexual lifestyle that contemporary men and women to choose a unmarriedcohabitation has played an important role in the social life. There are deep reasonsthat more and more people choose to the lifestyle of unmarried cohabitation in today’ssociety. Law has given citizen’s freedom to choose their own way of life, but withunmarried cohabitation appearing, it also happens a series of problems, of which theproperty problem relation to unmarried cohabitation are in particular. This article willregard the property problem involved in unmarried cohabitation as the breakthroughpoint, through analysis of domestic legalization status and its shortcomings comparewith the status and characters of foreigner unmarried cohabitation involved inproperty relations, several suggestions will be provided for domestic legalization ofunmarried cohabitation by this article.The main new point is the special view of discussing question according to socialproblems. For more and more cases are brought to the court involved in unmarriedcohabitation property and the lack of regulations established in China，so this paperfocus on the methods of researching which include comparative analysis andsummarizing and introduces some new results of foreign countries. In contrast withChinese legislation conditions. Then we hope to gain some important experiencethrough combining Chinese national situation.The research shows that there is a large space for improving our legislation withunmarried cohabitation. Many countries trend to the agreement between the partieswith the advanced power. If no agreement there is, the law maybe considers it as theco-ownership or joint-ownership. There will be the co-ownership unless the partiesobject. So the author suggests that we should take the conditional common propertybased on the national situation in China.
