The Research On The Order Of Legal Successors In China

Nowadays, the “Inheritance Law” in China has been practiced for nearly thirty yearssince1985. With the rapid development of social change and international environment, the“Inheritance Law” in China has gradually behind the pace of social development trend.Therefore, this paper focuses on the content about the order of succession in the “InheritanceLaw”, through the review of the development of "Inheritance Law" in China. Andcomparative analysis the inheritance law in other countries and main areas, also make somesuggestions of the order of legal successors in China presently.The author combines our traditional inheritance under international common culture andthe order of succession arrangements made with unique Chinese characteristics and moderatemoderate reform program. From traditional Chinese inherited culture as a starting point, andconsidering the legal inertia factor that reform efforts difficult too big, hoping to moderate andmoderate to modify the current reality can not be applied in succession provisions, increasingpart of the order of succession, and appropriate expansion Inheritance range.I believe that the first law of succession should be on top of the existing order, withappropriate changes to increase the order of succession; Secondly, the legal heir of the spouseas a zero order; Third, adjust the widowed daughter-in-law and widowed son-in-law ofinheritance, and changes to existing regulations and subrogation contradiction betweensystems.This paper is mainly divided into four parts, more than thirty thousand words.The firstpart mainly summarizes the main basis concept and determinant of the order of legalsuccessors.The second part inspects the history and development of inheritance law in China,to review it integrative so that clarify the ideas, and make a reference for the fourth part.Thethird part mainly analyzes the order of legal successors in the other countries and main areas,and compared the similarities and differences between countries and regions for the order oflegal successors, provides international vision and advanced experience of the order of legalsuccessors, in order to amend the laws in china.The fourth part combines the Chinese traditional culture with the order of legal succession in the world, to arrange the “InheritanceLaw” in China, and put forward the modest reform scheme with Chinese characteristics.
