Research On Road Accident Compensation Responsibility

With the continuous development of economy, society, and constantly promoting ofurbanization, motor vehicle ownership sharply increases, then road traffic safety situationbecomes worse. Road traffic accidents have risen to be the first killer of all accidents, directlyor indirectly threat the property and life safety of human. Social conflicts and disputes causedby road traffic accidents could not be taken lightly, because they would easily lead to socialinstability and disharmony.In order to further standardize the order of road traffic, prevent and contain fatal accidents,safeguard the legitimate rights of road accident victims, China has formulated andpromulgated the "Road Traffic Safety Law","Regulations for the Implementation of the RoadTraffic Safety Law","Mandatory Motor Vehicle Traffic Liability Insurance Regulations" anda series of judicial interpretation. But the liability principle of road traffic accidents, thedetermination of responsibility subject and the traffic Accident damages compensation arestill in dispute, while there isn’t a specialized law of road traffic accident damagescompensation to safeguard the legitimate rights of traffic victims. Therefore, combining withthe practical situation, this paper will investigate and study on the damage compensation ofroad traffic accidents in China, and put forward some constructive suggestions forimprovement.This paper includes three parts, introduction, body and conclusion. The body is dividedinto five chapters.In the first chapter, the author elaborates the concept of road traffic accident, analyses therelations and differences between the responsibility of road traffic accidents and road trafficaccident damages compensation.In the second chapter, the author discusses the normal important document and specialimportant document of road traffic accident damages compensating responsibility.In the third Chapter, the author analyses the concepts and types of the liability principleof road traffic accident damages compensation, detailed discuses the liability principle of roadtraffic accident damages compensation in China.In the forth Chapter, the author analyses the determination of road traffic accidentdamages compensation responsibility subject in China, and the specific determination of roadtraffic accident damages compensation responsibility subject in different conditions.In the fifth Chapter, the author analyses the system defect of road traffic accidentdamages compensation responsibility, then proposes some corresponding improvement suggestion and supporting measures.
