Research On The Law Enforcement Problem Of The Electronic Traffic Police

With the development of social economy and the improvement of the people’sliving standards, more and more private vehicles come into the ordinary family. Therapid increase of the private vehicles does not only give rise to great changes in trafficenvironment, but also the obvious and sharp conflict between modern road trafficsafety management and traditional way of law enforcement.This kind of phenomenon can also be found in the USA, the UK, France andGermany in1970s. At that time, these countries happened to take the same policynamed the Intelligent Transportation System(ITS) to resolve the stern traffic problemsand early or late they developed the ITS. One of the effective means in the system isvividly called by people the electronic traffic police. Practices of these countries haveproved the electronic traffic police is an indispensable way in road safety managementand in fact, it has been an important part in the ITS.For this reason, China has brought in this new law enforcement to relieve thegreat pressure enforcing the law that current traffic faces.The law enforcement by the electronic police has begun great advantages, but sofar in China it is still a new thing and there is less experience to reference.Unavoidably, there may be many problems like this or that, while it is just the rule ofevery new thing.The core of this paper is to make a preliminary study on the enforcement of thetraffic police by referring the information collected about the enforcement byelectronic traffic police and unresolved issues during the enforcement. This paperconsists three parts:The first part is the outline of the law enforcement by the electronic traffic police.To begin with, give the definition of the electronic police, define the law enforcementby it, and compare the differences between the off-site law enforcement and secretlaw enforcement in traffic management; Secondly, introduce the history and law basisof the law enforcement by the electronic police; The last one is the positive role of theelectronic enforcement.The second part is the analysis of several issues existing in the process of the lawenforcement by traffic police. These issues include lack of law basis, technologydefects of the enforcement, enforcement officers’ low quality and illegal enforcementprocedures. The third part is the countermeasures for improving enforcement by electronictraffic police, from the aspects such as development and refinement of legislation,regulatory enforcement, uniform technical standards, the establishment of aprofessional team, improving the functions of hardwires, and son on.
