Sandu Shui Autonomous County Of Non-study-material Cultural Heritage Protection Legislation

Sandu Shuizu autonomous county,(San Du for short below) located in thesoutheast of Qiannan Buyizu Shuizu autonomous prefecture, Gui zhou province is aregion with a long history and unique cultural environmental resources, where manykinds of national cultures collide, integrate, gestate the cultural variety and uniquenessof the Yunnan-Guizhou Plateau, display dense national specialty and the beauty ofraw type and form plenty and colorful cultural relics.In the long history of human being’s development, the Sandu people have createdcolorful national cultures and unique national customs such as the traditional festivalsincluding the Dragon Boat Festival and Mao Festival, the exquisite works of folksongs including Shuang song, Dan song, Dou song, Diao song and Jie song, the wildand enthusiastic gladiatorial dance, the solemn Shui nationality sacrificial rite, thesimple and elegant architecture with Ganlan style, the traditional cultures includinghandicraft works and Shui nationality Mawei embroidery known to the outsideworld,through their long-term production and living practice. They spread in materialand nonmaterial form in the folk world, never end and are handed down from onegeneration to another, depicting one beautiful Sandu national cultural picture. It is ofgreat importance to protect and make good use of Sandu cultural relics especially itsnonmaterial cultural heritage in implementation of scientific development view,accomplishment of comprehensive, harmonious and sustainable development of oureconomy and society.“Intangible cultural heritage law of the People’s Republic of China” passed in2,25th,2011and“intangible cultural heritage ordinance of Guizhou province" passedin3,30th,2012are the major legal grounds of implementation of protecting intangiblecultural heritage in Sandu. However, the two laws and regulation only protectintangible cultural heritage respectively from national level and provincial level andhave weak operability for the excessively general rulings in the process of protecting Sandu intangible cultural heritage. In order to meet the work need of protecting theintangible cultural heritage in the region, early in2008,“ordinance of protecting Shuibook of Sandu shui nationality autonomous county” aimed at the legal protection of“shui book” came out. Although Sandu has formulated some protective policies andcarried out a series of protective activities in the protection of intangible culturalheritage, the intangible cultural heritage in Sandu are not practically and effectivelylegally protected with the lack of the practically operable intangible cultural heritagelaws corresponding to the work nature of protecting the intangible cultural heritage inthis region. Therefore, it is an essential problem awaiting solution to set rules byreasonably using the edge of Sandu, a national autonomous county under the guide ofthe protective law and regulation of national level and provincial level and buildcorresponding protective legal system.In the paper, author first briefly introduces the composition of Sandu intangiblecultural heritage, analyze the present protective state and then point out theessentiality of protecting the intangible cultural heritage in Sandu. Next, authoranalyzes the legal survey of the protection of intangible cultural heritage from homeand abroad and illustrates some legislative experience available to Sandu. Finally,Author puts forth legislative accumulations about the protection of Sandu intangiblecultural heritage, analyzes the key problems in legislation awaiting solution, designlegislative protection system and drafts “intangible cultural protective ordinance ofSandu shui nationality autonomous county”. Author deep studies the legislativeprotection of Sandu intangible cultural heritage and build legal protection system withthe expectation that they can benefit Sandu in the protection of the intangible heritage,curbing the disappearance of intangible cultural resources, protecting the variety ofintangible cultural heritage and maintaining cultural safety so that the excellenttraditional culture in Sandu could be succeeded.
