A Preliminary Research On The Influence Of Network Public Opinionto Judicial Judgment

Since more than20years ago the Internet into our country, the development of theInternet in China have made great progress. The development of the Internet not onlychanges our way of life, it also made great changes in the way of our expression and theenvironment of speech, the formation and development of the network public opinion isone of the important results of the Internet development in China. Throughout thedevelopment of the network public opinion in China, hot case of judicial is undoubtedlyone of the main concern. Therefore, whether the understanding of network public opinionitself, or the network public opinion on its focus on the influence of object judicialproblems, has become the focus of academic research, the writing of this paper is based onthe attention of this problem.This paper is divided into five parts. The first part is introduction, mainly discussesthe background and significance of research, the present situation and the insufficiency ofthe research, and the research train of thought and method. The second part is a summaryof the network public opinion, focuses on the connotation and characteristics of thenetwork public opinion. The third part is function and interference of network publicopinion to the judicial judgment,In this part, through two typical cases, analyzed the thepositive role of network public opinion to the judicial justice and the bad interference ofnetwork public opinion to judicial independence. The fourth part discusses the reason ofthe influence that network public opinion to the judicial judgment, from their own factorsand event characteristics, social factors and reality. The fifth part is the balance mechanismof the influence of network public opinion on judicial judgment, hope that through thenews legislation and judicial reform and other methods, to provide effective method forthe balance of this influence.
