The stock market is an important part of the securities market. The configuration of the stock market for capital resources play an increasingly important and irreplaceable role. Good stock tax law system is particularly important to healthy and stable development of the stock market.At present, China’s stock tax system is relatively simple,not a standardized system,which is based on stamp duty as the main auxiliary income tax. The legal system due to systemic, taxes set unreasonable, there is the phenomenon of double taxation. Found by studying the three countries, the United States, Japan and Germany, more mature stock tax law system in the early stages of development of the stock market, mainly to turnover tax, income tax, supplemented; With the development of the stock market, and gradually reduce the tax rate of turnover tax, or even canceled turnover tax, and ultimately the turnover tax shift to income tax. In addition, investment income to avoid double taxation, to give some preferential policies for capital gains.The traditional stamp duty is essentially a certificate tax, affixed to the certificate printing tickets and pay. With the development of science and technology, the trading of the shares of listed companies electronic transfer of property rights no longer exist, stamp duty should be abolished, and instead levy a tax on stock transactions. As the basis of China’s stock market system is imperfect, the introduction of capital profits and taxes is difficult to effectively regulate the stock market, it is difficult to increase revenue, it is difficult to promote tax fairness, but we have to be fully prepared for the future introduction of a capital gains tax.To curb the gap between rich and poor in China further expanded, as soon as possible the introduction of a bequest tax.
