Research On The Application Of Polygraph Conclusion In The Criminal Proceedings Of Our Country

Almost from the appearance of lies, human started to search for methods to the analysis of lies. Similarly, the judicial practice also has been accompanied by a lie, and with the development of society, lies in the judicial performance is increasingly complicated. Each case always accompanied by the people to seek the truth "to" lie from beginning to end.Along with the development of society and technology, the hydraulic pulse polygraph, multi-parameter polygraph, acoustic analysis type of polygraph and other polygraph appeared one after another.Until the now, the polygraph technology has developed to a very high level, the accuracy rate has also been proof of a large number of research trials. Also the polygraph is widely used in litigation, and has played an essential role in the detection of cases and the chain of evidence constitute. Polygraph Conclusion in judicial practice has gone far away in front of the legislation, the request to incorporated polygraph into the legal system is strongly.But, our theorists for the Polygraph Conclusion into the legal system has maintained a cautious attitude.Therefore,the author analyzes and discusses the reliability theory and practice to proved the qualifications and probative value of the Polygraph Conclusion,and to have a in-depth analysis and discussion of the controversial issues that Polygraph Conclusion conducted in the practice.This article is divided into four chapters:The first chapter is the introduction of the concept, characteristics of Polygraph Conclusion.The author firstly have a simple conduct of the Polygraph Conclusion,and then through the analysis of scientific principle of Polygraph Conclusion draw the definition and characteristics of the Polygraph Conclusion, in order to deepen the understanding of the Polygraph Conclusion.The second chapter is introduced and summarized the extra-territorial application of the Polygraph Conclusion.Based on the recognition and application of Polygraph Conclusion in the world,then to classify,and concluded that Polygraph Conclusion has become an important means of criminal activities in the world.The third chapter demonstrates the qualification of Polygraph Conclusion in our criminal procedure and describes the situation and problems of Polygraph Conclusion in the practice.This is the focus of this article.In this chapter, through the controversy of Polygraph Conclusion in The theory,the author combined with the new Criminal Procedural Law of China that implemented on January1,2013to analysis the evidence qualification of the Polygraph Conclusion,in order to confirmed Polygraph Conclusion should have qualified in our criminal procedure. But also pointed out that the main problems of the Polygraph in our practice.The fourth chapter is about some legalization construction of Polygraph Conclusion. The author through to structure the technology system of Polygraph Conclusion that about eligibility requirements of Polygraph subject, polygraph technical operation and identification standard to ensure the Polygraph Conclusion scientific and accurate.In the aspect of the construction in the institutional development of proceedings that about Polygraph Conclusion, The author proposed building a Polygraph Conclusion startup program rules, the generated program rules, investigation and interrogation system,in order to ensure the realization of the litigation value of Polygraph Conclusion and the protection of human rights.The purpose of this thesis is to analysis the value in criminal proceedings, evidence qualification, legislation construction of the Polygraph Conclusion,hoping to early Polygraph Conclusion introducing evidence system of criminal proceedings.
