Unilaterally Terminate Labor Contract Discussion In China

Analysis of the theoretical framework of this thesis from the unilateral termination of laborcontract, straighten out the difference in the idea of the labor contract and civil contract, as well asthe basic legal concepts of the unilateral termination of labor contract. Based on comparing thedifferences between Chinese and foreign legal provisions on the unilateral termination of laborcontract law, grasp China’s emphasis on the rights protection, limited autonomy perspective.Author through discussion on some problems found in some judicial practice in China in twoaspects of substantive law and procedural law of unilateral lifting of the labor contract, and on thisbasis, combined with the practical needs, puts forward some legislative and judicial remedies.
