The Medical Legal Issues Enforcement

In recent years,"mental disease" cases emerge in an endless, in the media and the internet has caused heated debeat over a long period of time. In our country the study of compulsory medical treatment has experienced many twists and turns.Now over20years the mental health law finally officially enacted in October26,2012and will be in on May1,2013. Text according to the mental health law the regulations on compulsory medical treatment has not tripping unknown subject, unclear orientation of compulsory medical treatment system, lack of relief way and so on.The traditional theory of thought of compulsory medical treatment is one of security measures which belongs to criminal law regulation. But there are more and more scholars begin to face up to the compulsory medical administrative action attribute. This article is based on the compulsory medical administrative studies.This article through comparative analysis and case analysis method to the compulsory medical treatment system of legal issues related to do system research. This article include positioning, extraterritorial system comparison, the present situation of the compulsory mental treatment,system consummation and so on. Due to the compulsory mental treatment system in China still has not formed. This paper from two aspects of theory and practice to begin planning for China’s national conditions of compulsory mental treatment system.
