Study On Criminal Legislation Of Assault Against Police

China is in period of transformation where illegal and crime activities arehappening frequently alongwith growing malaise in society, during which, police hasbeen taking more liabilities to maintain social stability besides attacking crimes.While in recent years, it has occurred that police has been violent attacked by certaindoggy when executing duty, and the trend is growing. There are reasons for thefrequently happened violent attacks to police. Considering the legislation in regard toassaulting police in many other countries, we notice that China is stagnation oflegislation in this regard has limited effect in respect of regulating behaviors andattacking crimes.It remains controversial regarding whether or not to set a separate crime namefor assaulting police and how that would be defined. In this article, we intend tolook into the reality of society and legislation where the current laws and regulationscan not sufficiently protect police so as to demonstrate the importance and urgency ofsetting a separate crime of assaulting police to prevent officers being violent attackedand to strive for the dignity of law.Apart from the Introduction, this article is set in three parts and the structures areas follows:First part, the overview of crimes of assaulting police and the socialfactors leading to such crimes;Second part, analysis of necessity and feasibility of setting a crime name forassaulting police basing on the factor analyzing in first part; analyzing the feasibilityfrom the perspectives of politics, society and legislation.Third party, discussion in regard to legislation system and constitution of crimeof assaulting police. This party will be focusing on “4factors” to discuss theconstitution of crime. It will also be discusses and analyzed that whether or notauxiliary officers and police family are subjects of crime of assaulting police and howpolice can be protected against assaulting off duty.
