With the acceleration of urbanization and the migration of a large number of rural population, the number of mobile vendors is dramatically increasing. Street vendors struggle to make a living and meet the demands of low-income population in big cities. However, mobile vendors are confronted with the dilemma of being confiscated and banned due to their controversial legal status and the damage they bring to the municipal environment and transportation safety.To solve the contradiction of vendors’rights of life and urban management, different measures are taken. However, mere management can not solve the issue of street vendors. Street vendors are confronting with the trouble of acquiring their subject qualification. This paper gives an in-depth analysis of vendors’legal status from the perspective of civil and commercial law. This paper endows vendors with their subject qualification, which can make street vendors develop in a proper and legal way. This paper is to expound the necessity of street vendors in different perspectives and defines their legal subject qualification by adopting the method of historical literature research, comparative research and empirical research. This paper, borrowing the experience on identification and management of street vendors from different countries, puts forward suggestions on vendors’selection, qualification and management systems.This paper is divided into5parts. The first part:introduction. It introduces the background and the significance of my paper topic, analyzes the current dilemma of street vendors in China, proposed solutions to this issue and explains my research methodologies. The second part is divided into2chapters. The first chapter summarizes the basic issue of street vendors. This part gives different definitions to street vendors from diverse perspectives, makes conclusions of street vendors’basic features and provides their present situation of legislation in our country. The second chapter introduces the legal systems of street vendors from other areas and countries. The third part contains two chapters. The third chapter expounds the vendors’ existence necessity at present. The fourth chapter, judging from street vendors’civil and commercial disputes, the selection of subject types and its acquiring approach, analyzes street vendors’legal nature and clarifies the direction of vendors’legal reforms. The fourth part presents the improvement of the current street vendors’legal systems. Considering the features of street vendors, this part proposes the subject type system, the selection of registration system and the correspondent perfecting suggestions on management systems.The conclusion part briefly reflects and summarizes the whole paper.
