In judicial practice, procuratorial organ in the early nineteen ninties began to non prosecution of additional conditions made a series of fruitful exploration. The new criminal procedure law, the non prosecution of additional conditions legalization is a huge judicial progress, but because of the provisions on this system in the new criminal procedure law is too thin, so how to correctly understand and apply the conditional non prosecution system has become the urgent judicial practice of China’s procuratorial organs in question. This paper, starting from the concept of conditional non prosecution system the origin and the applicable conditions, in-depth analysis of non prosecution of additional conditions may exist in the specific application of the problem, and put forward reasonable suggestions to perfect the system of non prosecution of additional conditions, in order to use in practice to maximize the role of the system.
