Study On The Low Of The Standard Form In Network Transaction Of C2C

With the development of the commerce industry in China, the standard form of contract in network transaction of the Web Trade has become important more and more. And the standard form of contract in network transaction, unfair content of the format threat the potential of the consumers. Based on the problem, pay attention to the standard form of contract in network transaction, and focus on the consumer protection, has been the important study to improve the reasonableness of the standard contract term and the consumer right protection.This study combined with the case of Taobao to analysis the legal issues of the standard contract term in network transaction. Firstly, introduce the background, the aim and the mission, the way and the methods. Secondly, introduce the theory including content of the transaction model and the standard contract term, then analysis the contractual relationship and the responsibilities of the subject in the standard contract term in the transaction model of C2C. Thirdly, combined with the case of Taobao to analysis the problems within the standard contract term in C2C. Finally, to make the countermeasure from the legislative, the administrative, and the judicial system in order to promote the development of the standard contract term in the transaction model of C2C.
