Research On The Legal Problems Of Consumer Rights Protection In Network Transaction

With the development of international market e-commerce and network transaction, which possesses fictitious feature and rapid growth are getting flourishing as never before. Therefore, traditional law is hard to achieve the demands of protecting the market order. The tendency that consumer rights infraction online becomes even more badly. Fair trading rights, secured transaction rights, individual privacy protection, etc, which are suffering infraction without legal regime protecting. There are two reasons for such situation: on one hand, the feature of network transaction environment itself brings consumer rights infraction, such as information asymmetry, contract unreliability, funds transfer risk etc. On the other hand, Chinese legislation deficiency, imperfect law in network transaction cause consumer rights suffering in fraction,what's more consumers can not find relevant law to help themselves promptly.At present, we have no relevent laws about protecting consumer rights in network transaction. Consumer rights protection complies with"Consumer law"as well as other laws, however, which are established under tradition business circumstances. So it's hard to protect consumer legitimate interest in this special transaction. Therefore, in order to safeguard consumer rights in network transaction, the transaction place directed at market features and law deficiency must be completed and regulated.Under this circumstances, the writer's idea is according to the consumer rights protection and net work environment system demands. From the following aspects, the paper will design the law system aiming at the protecting of the consumer rights in network transaction. Firstly, strengthen and complete network transaction place regulatory regime, which is imperative with network transaction going safely and smoothly. Secondly, regulate information disclosure system in network transaction to ensure consumer get true and effective message while purchasing. Thirdly, create and complete individual privacy protection law system to make sure consumer rights are far away from been violated. Fourthly, create and complete network dispute handling system to ensure consumer relief rights realize rationally. No doubt, it is good for protecting the interests of consumers at network transactions though constructing these legal systems.
