Promote human rights and strive to achieve the lofty goal of Chinese socialism required the realization of full human rights is the Chinese government and people of a long-term historical task. I believe that through the joint efforts of all members of society in China, the legal protection of human rights in China will surely make a more comprehensive and profound progress.This article is divided into four parts. The first section describes the basic theory of the basic theory of government obligations and protection of human rights, and clarifies what government protection of human rights obligations, the need for and basis of the protection of human rights obligations. It also explains the reasons and content of government protection of human rights obligations to clarify the content of the obligation assumed by the government to protect human rights and why the protection of human rights obligations of the principal should be primarily the government to serve as. The second section describes the status of the protection of human rights legislation in China visits and deletion analysis, first expounded China to fulfill the obligations of the government of the protection of human rights practice, including the concrete practice of the China’s constitution, departmental laws described, based on these practices, pointing out deficiencies and problems, and to offer constructive ideas and reasonable proposals. The third part introduces the rich countries abroad, several human rights protection of practical experience and analysis of the legal measures of the Government to fulfill the protection of human rights obligations, after the adoption of some of the legal system suitable for China. The fourth part, in order to improve the Government to fulfill its human rights safeguards obligations put forward corresponding countermeasures, mainly through increasing the role of the Constitution in the administration, the establishment of the Constitutional Commission and constitutional litigation to strengthen supervision and improve the administrative legal system and administrative staff self-construction of two aspects.
