The Green Transition Of Chinese Legal System Of Pesticide Management

As an important means of production, pesticide plays an important role to improve theability of agricultural production and promote a steady high yield of agricultural production inChina. But pesticide on the ecological environment and human health is a great threat. Thepurpose of the green development of Chinese legal system of pesticide management iseffectively reduce pesticide damage to the environment and protect human body health at thesame time of maximum full play a positive role in pesticides. In fact, The greening of pesticidemanagement legal system in China has a history of the development process, only from theperspective of history, inspect the whole process of the development of green pesticidemanagement legal system of our country，we can be more objective view of legal system of thebackground and purpose，more comprehensive grasp law and tendency of it, and then find thegreen pesticide management legal system the best route to the comprehensive development.In this paper, according to the development of history, development of green pesticidemanagement legal system of our country can be divided into three stages, namely, greeninginfancy, greening the preliminary stage and greening the preliminary stage of development. Thepaper relates social factors such as politics, economy, as the background, the system of pesticideregistration, pesticide production system, management system of pesticides and pesticide usesystem are the main line of the study, which deep explores the change rule of pesticidemanagement legal system since the founding of new China, summarizes the achievements andfailures, and then explore the greening of legal system of pesticide management idea ofcomprehensive development law.This article is divided into five parts.The first part mainly studies the burgeoning pesticide management legal system. This stage,the policy is a major means of pesticide management and pesticide production is the maincontent of management. This part analyzes the pesticide production policy in detail, such as thequality requirements of pesticides, the development of efficient and low toxicity pesticides, the management of pesticide industrial "three wastes" and number of residual pesticide. This partaccurately summarizes the development situation of this stage.The second part mainly studies green pesticide management legal system of thepreliminary produce stage from1978to1997. This part firstly analyzes the macro legalenvironment of the pesticide management legal system in our country since the reform andopening， then summarizes the laws of pesticide registration system, production system,management system, using system, to show that pesticide management legal system is how toembody its characteristics of greening in this period.The third part mainly studies green pesticide management legal system of preliminarydevelopment stage since1997. International trade of the negative external pressure and thepositive construction of domestic pesticide management legal system jointly promote thegreening development of pesticide management legal system in our country. This part analyzesthe Pesticide Management Regulations and the Measures for the Implementation of the PesticideManagement Regulations and other normative legal documents. Finally it is concluded that Onthe basis of the previous stage, this period of greening legal system is how to preliminarydevelopment.The fourth part analyzes the change rule of the green pesticide management legal system.Firstly, this part reveals the change way of form and content of the pesticide management legalsystem. Secondly, under the guidance of the theory of institutional change, it is concluded thatthe pesticide management legal system in our country has experienced the evolutionary changeof the type of path dependence, which is influenced by the actor’s ideas.The fifth part expounds the preliminary idea for the further development of the greenpesticide management legal system. This part based on the paper before, and put forward thelegal idea for the further development of the green pesticide management law. The author thinksthat the increase of regulation, the establishment of the new system such as pesticide businesslicense system, pesticide waste recycling system, and the improvement of the penalty clause willbe the best path to promote the development of green pesticide management legal system.
