Judicial activism since it was formally put forward, become the focus of discussion of judicial practice and law theory. Based on this, this paper intends to participate in social management People’s Court Perspective, analyse the proposed of active judicial background, theoretical foundation, the connotation, characteristics, the plight and the relationship among passive justice, judicial restraint, the Western Judicial Activism. By reference, citing the view of many scholars, combined with active judicial practice cases to summarize the relevant issues, And explore the dynamic relationship between justice and social management, in order to active the People’s Court of Justice whether as a new path to participate in social management and make recommendations to the solution.
