On The Multinational Environmental Pollution And Its Legal Regulation In China

After the1990s, multinational companies with its strong economic strength andadvanced production technology the amount of investment in China increased significantly,while promoting China’s economic development and create a lot of revenue for our finances,our country’s economic development a huge economic benefits, it also consumes vastresources of our country, even to the country caused serious environmental damage, hasaroused widespread concern in China for multinational environmental violations. Due to thelegal regulation of multinational companies in terms of environmental responsibility is notperfect, there are legal gaps for multinational companies in China to pass on pollution provideconvenient conditions, these multinational companies in China will take advantage ofloopholes in the law in their home country environmental protection or even "zero pollution",but in our branch, but only reached the minimum standards of environmental protection laws.Therefore, this difference multinationals environmental practices in urgent need of treatmentfrom a legal point of multinational companies in China to regulate pollution through ourcountry, in order to promote balanced and harmonious ecological environmental protectionand economic development of our country between. Current environmental problems causedby multinational companies in China have received wide attention of scholars, through thestudy on the issue of environmental pollution and its legal aspects multinational companies,not only helps enrich our environment pollution and multinational companies in China itstheoretical research legal regulation, but also to promote the continuous improvement ofChina’s legal system in China, multinational environmental pollution, so in practice formultinational effective legal regulation of environmental pollution in China, so thatenvironmental violations during treatment when a legal basis.In this paper, research methods literature analysis, the full use of the school library,CNKI, Wang Fang data, CQVIP and other resources, to collect a lot of research onmultinational environmental aspects of legal regulation, by reading, sorting and induction,more comprehensive accurately grasp the current domestic and multinational forefront oftheoretical results on the legal regulation of environmental pollution aspects. The first part is an introduction, first briefly describes the purpose and significance of this paper, and thenpoint to research methods and innovative research status at home and abroad, and this paperconducted a comprehensive review. The second part is a multinational environmentalpollution in China provides an overview, first of environmental pollution and other relatedconcepts were initially identified, and an increasing number of transnational corporations andmultinational companies from the consequences of environmental pollution in China causedby environmental pollution in China, two aspects to analyze current situation in China,multinational environmental pollution, environmental problems caused by multinationalcompanies in our country is very serious. First, it should improve the legalenvironment responsibilities of transnational corporations in China, in the law explicitlymultinational environmental responsibility in China, and also to enhance the transparency ofmultinational environmental responsibility in China; Second, law enforcement andenvironmental protection should be increased implementation of environmental regulatorymeasures must increase the execution of environmental protection, but also the strictimplementation of environmental regulatory measures; third, it should improve the accessthreshold for foreign investment environment, not only need to improve the access of foreigninvestment approval system, but also the environmental impact assessment system a certainperfection; fourth, should strengthen international cooperation with international cooperationmultinational companies in home countries is a necessary means to solve internationalproblems, not only to strengthen communication and cooperation with the multinationalenvironment of the home country, must also be carried out with multinational home countriesenvironmental regulatory cooperation; fifth, should improve the international regulatorysystem for multinational environmental pollution provisions in the formulation of international rules must comply with environmental responsibility concept of fairness andjustice, and also to continue to strengthen the role of multinational international soft law.In short, we want to strengthen our legal regulation of multinational corporations inChina’s environmental pollution, regulate multinational companies in China’s environmentalbehavior of multinational companies in China to curb the growing trend of environmentalpollution, prevent or reduce environmental pollution caused by multinational companies inChina.
