Research Of Legal And Policy Issues Of Multinational Environmental Responsibility

The environmental responsibilities of multinational companies to multinational companies bear legal responsibility on the protection of the environment and resources, including two levels of meaning:The first level refers to the multinational companies shall comply with the requirements of environmental protection under the law, and shall perform obligations, the meaning of the second level is the adverse consequences on the multinational companies because of their violation of the requirements of environmental laws and to bear the legal and multinational companies due to the violation of environmental laws in accordance with the law held liable.Multinational companies is an important economic organizations, they are not only blowing hot and cold in the economic field, and part of multinational companies has also become irrational international economic order under the pollution passed on the carrier by virtue of advanced technology and abundant strength. The reason for this phenomenon include:multinational corporations law and policy of environmental responsibility in the regulation of the host country is imperfect, multinational corporations have loopholes; multinational companies to implement unified environmental policy, namely for home and host countries in meeting their environmental responsibilities." double standards "; the host country in the developed stage, consideration of multinational corporations in economic development is much larger than the negative impact on the environment to consider.In view of the Multi-National Corporation of environmental legal liability existing pollution transfer convenience and avoid environmental legal responsibility for the convenience of,establishing a sound environmental legal responsibility mechanism, either in theory or in practice are of great significance.Based on this thesis describes research on multinational environmental liability issues,starting from international and foreign law for the regulation of multinational environmental laws,introduced the regulation of international and foreign law for multinational environmental liability for the reference to China,Liability and the existence of the multinational environment of the study in China,and put forward a sound countermeasures. Paper to conduct feasibility studies on these issues from the following aspects. The first is an overview of the multinational environmental liability,define the concept of responsibility of multinational corporations, multinational environmental laws, to analyze the characteristics of connotation, and to study the form of liability of multinational environmental responsibility.Second is the status of international law and foreign law for the regulation of the legal responsibilities of multinational environment,introduced international law, the status quo of American and Japanese multinational environmental laws and regulations,gain the inspiration to establish and improve the environmental liability on our country.Once again, the problems of research in China for an overview of multinational environmental liability and respectively from the three aspects of the environment, civil liability, environmental and administrative responsibility with the environment, criminal responsibility to find out the shortcomings of our country for the regulation of multinational environmental liability.Finally, before concluding text, from civil liability, environmental administrative responsibility, environmental criminal liability and related systems of multinational environmental liability to proceed, put forward a sound proposal.
