Legal Problems Of Digital Inheritance

With the rapid development of Internet, disputes about the growing digital heritage.So the digital heritage protection is particularly important. Legal protection of digitalheritage is produced along with the network’s new problems. States regarding theproperties of the digital heritage objects, as well as the definition of the legal nature of thedigital heritage are matters of inheritance, there are still large controversy. Digital heritageprotection law also is still blank, and the traditional law can not directly applicable in thedigital heritage, the court in adjudicating cases, the situation faced no legal basis, so thatthe digital heritage disputes can not be effectively resolved, digital heritage protectiondifficult to get the right people, but also on the development of China’s Internet economyadversely affected. With the development of the network, and more need for further legalissues related to digital heritage to explore, build digital heritage legal protection system.Thus, the urgent need to come up with the digital heritage protection legislation, to makeup for its research gaps, so that problems in theory and practice to be effectively addressed.Although written in the existing laws on inheritance issues related to digital is notparticularly clear rules, this does not prevent us from exploring this issue. In this paper, theuse of comparative research methods, research methods literature, the concept of digitalheritage studies comparing foreign and Taiwan, China, Hong Kong in the digital heritageachievements in theory and judicial practice, a clear legal nature of the digital heritage,digital heritage objects identified properties, analysis of China’s digital inheritance for theProtection of the problem, which made perfect digital inheritance advice, in order to betterbuild and improve the legal protection of digital heritage.
