In2013, many scholars as the first year of the Internet financial, this year thebalance of thetreasure and Micro message money as the representative of the new financial model suchas bamboo shoots after a spring rain like emerge in large numbers. However, the boomingof Internet finance is a relative of our legislation on Internet, financial and other forms ofnetwork economy is still not perfect, which leads to the Internetfinancial consumers inChina and the relevant fund benefit cannot get effective protection. Therefore, this papertry to analyze the electronic contract and put forward some legislative suggestions, hopingto protect the interests of partiesof electronic contract from the perspective of contract law.This paper tries to put forward by electronic contract issues, to analysis the existingproblems and the current contract law of electronic contract, put forward the correspondingcountermeasures, hope for legislation to protect the interests of parties of electroniccontract from the perspective of contract law.In this paper, through the analysis of the present situation of the electronic contract inChina, to explore the current legislation powerless to electronic contract specification,specific performance for the laws, regulations of our country to regulate the electroniccontract is insufficient, and the current legislation of electronic contract can not be the verygood protection. Therefore, based on the developed market economy countries legislativeexperience, combined with the specific characteristics of China’s national conditions andthe electronic contract, from the double angles of theory and Practice on how to betterprotect the interests of the parties of electronic contract, recommended the introduction ofspecial "law on electronic commerce", and the establishment of specialized enforcementagencies. The purpose of this paper is to comply with the international trend of electroniccontract legislation, put forward the legislative suggestion regulation of Chinese electroniccontract.
