Scope Of Jointly Owned Property

China has already established a relatively complete legal system of marriage law, butalso stipulating the range of Couple’s common property clearly. However the definition ofthe basic scope of jointly owned property, which on existing laws and judicialinterpretation of existing law still not clear enough. In this paper, the scope of the jointlyowned property as a research object in order to improve the scope of jointly ownedproperty. The text is divided into four main parts:The first part introduces the basic theory of marital property system, summarizes thelegislative and judicial interpretation of marriage provisions on jointly owned property inhistory.The second part analyzes the current legislation. This section of the threedimensions--time, subject, In according to the three object, analyzing the defined of jointlyowned property in our current legislation.The third part analyzes the relationship between the couple’s joint property andpersonal property. This part is also puts forward some suggestions to improve the existinglegislation.The fourth part discusses two types of intangible assets with the hugecontroversy---intellectual interests and expectations of human capital, whether they shouldbe included in the scope of jointly owned property. Both intangible assets are recentlywidespread controversy for several years.
