Research On Legal Problems Of Insurance Agents

Insurance agency is one of the insurance business operation modes, and it is also the application of agent system and concept of agent in insurance marketing. Developed countries widely used system of insurance agent; Foreign mature insurance market is mainly composed of the insurance company, insurance agent and insurance broker, insurance assessment companies together. Since the reform and opening up in China, the insurance agency has exogenously promoted the rapid development of the insurance industry, but it also caused many problems, one of the most core issues is the phenomenon of insurance agent illegal sale insurance is serious. Based on the perspective of law, rounding the core problem of insurance agency in our country, this paper put forward the targeted countermeasures on the basis of mature experience in foreign developed countries.This article is divided into four parts:The first part is basic theory part. This part mainly analyzes the concept of agency and the insurance agency, elaborates on the features of insurance agency as a professional agent and also summarizes the generation and development of the insurance agency.The second part elaborates the insurance agency legal relationship produce, content and terminated. Firstly, this paper analyzes the basis of the insurance agency legal relations, which leads to the specialized agency of the complex agent right problem. Secondly this paper discusses the relationship between rights and obligations in the insurance agent. Finally, the author analyzes the reasons and consequences of insurance agency legal relationship termination.The third part using the methods of empirical analysis and comparative analysis discusses the law problems in insurance agency. It mainly includes the unclear legal status of insurance agent; imperfect inform obligation of insurance agent system; imperfect insurance agent regulatory system, weak supervision and other issues.The fourth part puts forward the countermeasures to solve the problem. Firstly judicial review standard legal status of insurance agent is proposed. Secondly this paper discusses the suggestions of improving the system of insurance agent inform obligation. Finally the paper proposes to establish classification regulation system of insurance agent and training system, and strengthens supervision.
