The Research Of The Residential Usufruct Regime In China’s Urbanization

Urbanization is must for a country’s modernization, especially in China. Nowadays, China as the biggest developing country in the world, has more than50%urbanization rate, that will be a profound implication for promoting China’s modernization and urbanization."America’s information-based progressing and China’s urbanization is now changing the whole world at the beginning of21st century" Nobel winner Joseph Stiglitz once said. As China’s urbanization scale is being continuously expanded, more and more rural residential land expropriated, also lead to more problems, such as the house prices increasing, the small property house transaction, the contradiction between the urbanization developing and the rural dilapidated, especially the rural erecting houses and other buildings without governmental planning and permission. So the purpose of this paper is analyzing and solving these problems.This thesis mainly divides into4parts.Part1: What’s the urbanization and the usufruct of residential land. Include conceptions, historical development, impact and inspiration.Part2:What’s the present situation, problems and reasons of the residential usufruct in China’s urbanization. Include analyzing the existed problems, and the sources of these problems.Part3:How to solve these problems in the based on the real situation of China. Include establishing and improving the relevant laws and policies for assignment, transference and extinction of the residential usufruct in China’s urbanization.Part4:Giving an example of residential usufruct reformation in Shunde, Guangdong. Include analyzing the conception, existed problems of Shunde’s homestead curing reformation, and then raising corresponding countermeasures.
