Perfection Of The Judicial Police Prosecution System

According to the "Organization Act of the People’s Republic of China’ procuratorate" and "Police Act of People’s Republic of China", As a kind of police, judicial police in procuratorial organ serves as both roles of special armed team and law executor. As stated in the "Temporary Ordinance of Judicial Police in Procuratorial Organ" and "Regulation of Judicial Police in Procuratorial Organ’s Duty", the judicial police is responsible for protection of crime scene, escorting criminals, summons delivery, execution of compulsory measures, participating investigation and other legal functions. As the development of Chinese legal society, procuratorial organ become more and more important in punishment, supervision, control, education of prevention and protection. With its special nature, the judicial police takes more responsibility in case handling quality assurance, security, supervision on legal execution. The new situation, new task, new law, new standard and new regulation make a new request to the level and range of judicial police. However, the relative law and regulations stayed unchanged. So it’s necessary to improve and perfect the relative law and regulation for a professional and standard judicial police team.The procuratorial organ need to separate the arresting and appealing in criminal case handling, separate investigation, arresting and appealing in internal case handling. Setup both cooperation and constraints relationships between departments. The practice proved that to educate and regulate the police with proper system and regulation is the only way to setup a standard, professional and powerful judicial police team and to make a higher internal authority and efficiency in case handling. Here, we could see the judicial police’s irreplaceable statue in procuratorial work. Only the law and regulation developed, could the procuratorial work be more efficient, healthy and orderly.Therefore, the author takes Hulunbeier procuratorate’s construction situation of judicial police team as an example. By analyzing the current problems of insufficient law, unclear norms, imperfect accountability mechanisms and specific characteristics of this region with minority and port, the author point out the problem and deficiency in legal norms and put forward the relative suggestions to perfect the current norms and practice for the judicial police in our procuratorial organ, which would be very important to the legislative and judicial practice.
