| As our country’s socialist market economy，development，our housing system has beenreformed，many people in the city choose purchasing their own houses,so a new industry–property service industry has emerged. It is that through the special services providing to theowners, and the owners pay the reasonable price periodically. Although property service inour country has developed for20years, compared with overseas property services, we are stilllack of the property system in our country, the result is many difficulties in implementing theproperty services contract, and many property disputes are emerging.Base on the theoretical problems, this article combining with the practice in the casespresents some problem existing in the service contract.The first chapter is the preface that introduces the background and the writing purpose.Based on the management experience of cases, this article put forward constructive methods.It also introduces the writing methods and the innovations.The second chapter is the summary. In this part, it introduces the definition, concludesthe characteristics, on the basis of the theory, it also gives the two classification of thecontract, after comparison with the other contracts, it decides that property services contract isnot concluded in the15named contracts of Contract Law,which is different from the others.The third chapter is the specific of the property services contract. This part introduces thesubjects of the contract, as well as the validity、release and bearing the liability for breach ofcontract, which has laid a good foundation for the followings.The fourth chapter summarizes some problems existing in our service contract.Combined the former part with the practice of the cases, this part raises some problems.The fifth chapter presents several methods which are very practical, With the good ideas,service provided by the enterprises will be developed later, and thus reduce the disputesbetween the owners and the service enterprises. |
