The article is based on the perspective of anti-employment discrimination legislation by explaining the concept of employment discrimination. It fully demonstrats the connotation and extension of employment discrimination. By analysing the comparative study of legislation against discrimination in employment of Britain and other countries, we can note that the problem of employment discrimination in the legal system and the inadequacies of the current situation and put forward a sound legal system of employment discrimination against a number of recommendations.Besides the preface and conclusion, this dissertation is divided into four parts as follows.:Chapter One is manly about the overview of employment discrimination. The first section analyzes the basic questions about the meaning and type of discrimination in employment. Section Ⅱ gives the reasons of it.It analysis of employment discrimination arising into the causes of economic reasons refers to institutional factors, institutional factors, historical and cultural factors, social prejudice or preference factors, statistical discrimination factor, double labor market discrimination factor. Section Ⅲ describes the type of employment discrimination.Chapter Two is manly about foreign anti-employment discrimination Legislation. The first two sections of this chapter analyzes the UK and the U.S. anti-employment discrimination legislation and judicial practice, and also analyzs the comparison of the two main legal requirements in the treatment constitutes direct discrimination or differential treatment discrimination. Section Ⅲ identifies foreign anti-employment discrimination legislation enlightenment to our country, shows that China can learn from foreign practices in the following areas:Legislation perfect concept to define a comprehensive, robust institutional settings, the clear burden of proof.Chapter Three relates to improvement of China’s anti-employment discrimination legal system. Section I presents the current situation of discrimination in employment statistics cited by investigative agencies. Section II focuses on analysis of the common types of employment discrimination Section III elaborate China’s current status of anti-employment discrimination legislation, and points out that China’s current anti-discrimination in employment problems and deficiencies. Section IV put forward a sound legal system of China’s anti-employment discrimination proposals mainly from the legislative, legal and judicial.
