On The Civil Protection Of Personal Information

As the information society based resources, personal information transmission, processing and utilization with the development of information technology has become more flexible, but efficient, convenient information transfer process also leads to personal information more easily suffer from improper collection, malicious use and then endanger the personality, property safety. Therefore, the protection of personal information has become a legal issue of globalization, more and more countries, international organizations have legislation to protect personal information. In China, the legislation of personal information protection is still blank, special protection law does not develop, personal information protection is relatively weak, is not conducive to the protection of.Personal information with the personality and property dualism, the protection of personal information is its personality interests based on, and even the property interests, so the civil law protection of personal information should be in the theory circle is the consensus. This article is from the perspective of the civil law, the integrated use of the concept of law, comparative law analysis approach, discuss the problems of civil law on the protection of personal information. This paper is divided into three chapters to study on civil law protection of personal information in China:the first chapter describes the basic theory of personal information, relationship and difference of personal information and the related concept definition, concept, characteristics of the civil law nature of the personal information, personal information. The third chapter analyzes the current situation of personal information protection legislation in China, analyzes the existing problems, and from the mode of legislation, supervision mechanism, civil relief six aspects, proposed building a personal information protection system of our country should, in order to benefit the legislation, the protection of personal information in china.
