Study To The National Legislature Inquisition Power Of Japan

Japan established a constitutional monarchy modeled on Britain, and absorbed the British’s Parliament centrism, amended the Constitution after World War Ⅱ under Allied controlled, to follow the United States to establish a system of separation of powers. So the Japan political system compromise the United States and Britain, Congress has both functions to guide national policy, but also enjoy the power constraints on the executive and the judiciary to supervise. The independence of the judiciary has been very good in Japan, some of the powers of Congress such as the national legislature inquisition power focused on the violations and corruptions of Japan government agencies. The national legislature inquisition power of Japan plays an important system functions in Japan Congress, is explicitly written in Constitution of Japan, is a World War II Japanese parliament powers enhanced performance. We can learn some operational procedures and specific regime from the national legislature inquisition power system.Firstly, the paper has a Systematical research on the national legislature inquisition system, and then do a brief introduction to China’s specific issues survey system, and then compared with the national legislature inquisition system from the political context, subject, scope, systems and procedures, etc. And analysis the deficiencies of our system and discussed from the perspective of learning how to improve China’s National People’s Congress specific issues survey system.This paper is divided into three parts:The first part describes the meaning, the background of the national legislature inquisition system of Japan and China’s similar provision. The second part is the core of this article, from the investigation subject, investigation scope, survey instruments and several aspects of the program to do a detailed study. The third part first introduces the contents and status of China’s specific issues investigation of NPC and then compared with the national legislature inquisition system from any aspects. Then analysis our defects, lastly discussed from the perspective of learning how to improve Chinese specific issues investigation system of NPC, to pursue the political responsibility of the executive way to promote its administration, and maintenance of civil rights.
