The Problems And Strategies Of Labor Security Legislation

The employment security right is considered as one of the most importance by the International labor organization. And the further research of employment security right to protect the interests of labor which promotes the development of our society in many aspects.In a word, we are to adopt a series of measures to protect the employment security right, there is a huge gap between our country and advanced countries in legislation field, there are still a lot to be done. When the employment security right is under the protection so that the justice and the authority can be abide by law.In the first part of this thesis, the author makes a brief overview of the basic theory through different angles illustrating the importance of employment security right. Labor safety authority refers to labor safety and health protection of workers and protect them from occupational injuries in labor rights. Judging from the object to be protected, it can be split for the workers and employers, both in terms of workers to provide labor and services, the employer is obliged to provide a safe workplace for workers in the workplace, so that workers in labor process is protected. From the terms of the objectives is to protect workers’ labor. From the perspective of the employer’s point of view, they are safe for work outside the labor process assumes no obligations. Labor safety is a fundamental right for labor safety protection reflects the respect for human values of life.On the basis of the first part, the second part further discusses the historical evolution of legislation to emphasize the significance to establish a well-written legal mechanism. All countries will make every effort to standardize and the employment security as well as to establish a well-organized supervision system.The third part through the analysis of the current situation in our country leads to the fourth part which provides some suggestion to develop and strengthen our legal-related system."Labor Law" stipulates that in the interests of the workers have been infringed may apply to the People’s Government and the relevant law enforcement authorities for help, adjusted for labor relations between the employer and the employee, the relevant administrative law enforcement departments shall supervise compliance with the employer in accordance with the labor health and safety rules to act. Government has a responsibility to act in the national and legal rights under the supervision of the employer. From the establishment of a sound system of labor safety and hygiene, strict implementation of national occupational safety and health regulations and standards, occupational safety and health for workers of education; occupational safety and health facilities must meet state standards; new construction, renovation, expansion project labor safety and sanitation facilities must be with the main project designed, constructed and put into production and use; employer must comply with state regulations to provide occupational safety and health conditions and necessary labor protection articles for the laborers engaged in work with occupational hazards regular health workers check; workers engaged in special operations must undergo specialized training and acquire special operations qualifications; workers in the labor process must strictly observe safety rules; countries to establish injury and disease statistics reporting and handling system and labor perspectives on security-related matters and procedures provided for.For no specific legislation to protect labor safety system, security of the labor content is not clear, for violation of labor rights of the punishment is too light security, government agencies and personnel responsibilities are not clearly related to other issues, the fourth part of the improvement of occupational safety and health the basic concept of the right to commence legal protection, including a supplement to the basic principles of legislation, the development of specialized labor safety protection against labor legislation and to increase the security of the behavior of punishment.
