Research On The Protection Of Labor Safety Rights And Interests Of Crowdsourcing Riders On Food Delivery Platforms Under The Background Of New Business Formats

With the rapid development of technologies in sharing economy and platform economics,new business formats based on the “Internet +” platform have emerged.Compared with traditional economic models and business formats,the labor rights protection issues as well as the appropriate measures in the new business formats have not been systematically organized,which leads to the chaos in personnel management in the new business platforms.The rights and interests in elderly care,work-related injury,childbirth,and medical care of the practitioners in the new business forms are not effectively guaranteed,which,to some extent,has hindered the long-term development and viability of the new business form.Because of the flexible and various characteristics of the new business forms,the employment mode formed in the process of operating through the internet in different industry is too complex to be enumerated one by one.However,as one of the new forms of employment,the crowdsourced rider in the takeaway platforms has a clear characteristics of part-time employment and shared employment,which attracts an increasing number of migrant workers of the new generation.Therefore,this paper takes the crowdsourced rider in the takeaway platforms as an example and analyses the dilemma of the protection in the rights of labor safety in the new business forms.It puts forward corresponding countermeasures and suggestions for the government,market and social organizations to play their role in the protection of labor safety rights and interests of crowdsourced riders.Specifically,it is explored how to secure the basic labor rights of the practitioners in the new business forms.This paper combs the relevant literature and defines the concepts.Besides,it expounds the current situation of labor safety rights and interests protection of crowdsourced riders on the takeout platform.It can be seen from the government's policies and measures that the government has been committed to protecting the labor rights and interests of crowdsourced riders on the takeout platform in recent years,and various measures and opinions are filling the gaps in policies,laws and regulations.From the perspective of enterprise security measures,although it responded to various guiding opinions put forward by the state,generally speaking,various rights and interests protection systems are not perfect.In order to better understand the deficiencies in the labor rights and interests protection of crowdsourced riders on the takeout platform,this paper designs the survey content,questionnaire and interview.Through a comprehensive analysis of the labor safety guarantee of crowdsourced riders,it is found that the current delivery platform crowdsourced riders generally have low income,overload work pressure,insufficient safety protection,too long working hours and lack of occupational injury insurance.The lack of these labor safety rights and interests comes from the problems of collaborative governance.From the lack of Government Coordination Authority,the non-standard employment of enterprises,and the failure of crowdsourcing riders to form an independent rights protection organization,it can be seen that there are their own limitations and deficiencies of the main body of collaborative governance.From the unclear division of rights and responsibilities of relevant departments,the blocked channels of government and enterprise information sharing The failure of multi-agent collaborative governance can be found in the lack of cooperation enthusiasm of all parties,and the causes of these problems mainly include two aspects: the lack of awareness of multi-agent collaborative governance;The cooperative governance mechanism of multiple subjects is not perfect.In view of these problems and causes,it also puts forward corresponding countermeasures and suggestions to strengthen the protection of labor safety rights and interests of crowdsourced riders on the takeout platform: improve the awareness of multi-agent collaborative governance and improve the mechanism of collaborative governance process.It is hoped that the research of this paper can make the policy formulation more in line with the characteristics of industry development,and then promote the healthy,rapid and high-quality development of new business forms.
