Promoting The Development Of The Lawyer Industry

Ruled by law is the basic way of governing a country and The Third Plenum of18th CPC Central Committee definitely determined the task of promoting law-ruled China construction, which is an important part of protecting lawyer’s practicing right, perfecting lawyer’s illegal practicing punishment system, and promoting the legal right protection of citizen and corporation by lawyer. The lawyer whole are the key force of law-ruled China construction, and its development degree reflects the legal construction level of China. This thesis makes research mainly by case and also by questionnaire survey, analyses the problems of lawyer profession development, and gives some suggestions in correspond.This thesis has five chapters. Chapter1is about the thesis topic origin and research aim. Chapter2analyses3development stages of Huzhou lawyer profession:origination, rebuilding, and completely new development. The rebuilding stage set a good foundation for completely new development stage when every index of lawyer profession development increased fast. Chapter3demonstrates the performance of Huzhou lawyer profession development, while by support of government and the lawyer association, and also by effort of lawyer and law firm themselves, the lawyer profession is specialized and develops fast partly:the quantity of lawyer and law firm increases steady, the legal service quality advances constantly, the development prospect gets better, the service capability improves, the lawyer management system innovates, and the lawyer take an important rule in law-ruled China construction. Chapter4analyses the problems of Huzhou lawyer profession development which can be divided to inner and outer problems:the inner problem is about the profession philosophy, the service quantity and extension, specialized level and social reputation of lawyer etc. The outer problem is about that the society takes wrong opinions about lawyer function, the market entities do not trust lawyers, the new tax rule takes disadvantages for lawyer, and the lawyer’s practicing environment should be improved etc. Chapter5analyses the problems of Huzhou lawyer profession development through inner and outer factors, and gives suggestions from6aspects of lawyer, law firm, the government, and related regulations for lawyer profession development, which are expanding the legal service quantity, giving policy supports, improving the practicing environment, strengthening the lawyer culture construction, taking efforts on specialized development of lawyer and law firm, and innovating tax rules to decrease the disadvantage of "turnover tax turn to value-added tax" policy.
