Path Of Realization Of Justice

In the continuous progress of judicial system reform, novel social behaviors and disputes emerge frequently. What’s more, problems that impede judicial justice arise continuously, which asks for a higher standard for the definition of justice. Citizens’daily higher attention on justice makes justice an important quota of social civilization development and harmonious progress. However, more explorations and efforts need to be taken in order to finally achieve justice.This thesis is based on the macro background of the present social situation, starting from the connotation of judicature and judicial justice. On the basis of analyzing problems existing in the process of achieving judicial justice, as well as the value and criteria of judicial justice, a novel method that improves judicial justice and is in accordance with the current progress of China was proposed in this thesis. And hopefully it will help improving the judicial justice in our country. Five parts are included:Part I. Background, purpose and significance. A summary of research status and methods was given.Part II. The connotation of judicature and judicial justice. The connotation of judicial justice was discussed starting from the feature of judicature and the value of judicial justice.Part III. The criteria of judicial justice. Analyzing different views about the criteria of judicial justice. A statement was given that judicial justice is relative, and the criteria of justice includes both substantive justice and procedural justice, and social standard.Part IV. Through analyzing the specific forms of judicial justice in our country, the factors that affect judicial justice were discussed.Part V. Combining the current development and the difficulty of judicial justice of China, a realistic method that improves judicial justice and solves problems that occurs in the process of achieving judicial justice was proposed.
