The Extensibility Of Copyright Collective Management Organization In China

Copyright collective management organization is an important part in the protection of copyright law system, the organization not only reduce transaction cost、 speed up transaction rate、improve the security of copy owners and users concerned, but also promote the cultural communication.Due to various reasons,China started late on the collective management organization system, there is big gap compared to the developed countries、however, through a lot of financial、material investment and learning the advanced experience, the collective organization system has a rapid development, and plays a role to maintain the interests of copyright owners in a growing number of copyright infringement. However, with the development of internet, its characteristic such as semi-official、the imperfection of distribution system and some external reasons, lead to many problems in the operation of collective organization,the newly 《Copyright Law》(revision draft) attempt to solve above problems, but some clauses caused great controversial. Based on the controversial argument this paper will expound resonability and feasibility of the collective organization, at last, this paper will put forward some suggestions about China’ collective organization. In addition to preface and conclusion, this paper will divide into four parts.The first part will have a summary about the copyright collective organization.lt introduce the history and present situation of the copyright collective organization,thus analyze the collective organization’ connotation and characteristics.The second part will analyze existing problems and content in the present 《Copyright Law》,and introduce the issues raised by the relevant provisions of the draft.The third part will discuss the resonability and feasibility of the extensive collective organization in our country. Through above analysis we will obtain a conclusion that we can establish a extensibility collective organization in our country.The fourth part will put forward some suggestions about the copyright extensive collective organization in China. Such as the control limit of the collective organization、the perfect supporting measures of extensive collective organization、 introduce competition mechanism appropriate、the perfect charge of royalty and the mode of distribution, thus put forward some suggestions about our country’ extensive collective organization.
