The Study Of Legal Issues Retirement System

Since the founding of new China, Retirement System has a history of more than half a century, with the rapid development of social economy, and the relevant laws and regulations of the retirement system obviously can not keep up with the pace of socio-economic development. Therefore, need to update and perfect, so as to better safeguard the interests of workers. In the process, the pursuit of equality, fairness and retirement systems, as the ultimate goal, and embodies the humanistic care for vulnerable groups in the implementation process. So, in order to retirement legislation as the research object, a series of legal problems existing retirement system are studied relatively deeply. The paper can be divided into four parts:the first part is the brief introduction to retirement system including the definition of retirement and retirement system and historical development of Retirement System. The second part is the study of retirement age, the legal protection of pension payment and the reality confusion of retirement rights of legal relief, those are three aspects of retirement rights, and learning from good practices in other countries is more beneficial to improve our system. The third part of the development status of China’s current retirement system, mainly analysis of issues arising from retirement system development. The last part proposes improving our retirement system from three aspects:1.reasonably standard retirement age;2. Two-track reform of pension payment;3. improve the legal relief of retirement rights.
