Mention Of China’s Civil Environmental Public Interest Litigation

With the development of the economic, environmental issues become increasinglyprominent, civil environmental public interest litigation is also increasingly concerned.Section55of the Civil Procedure Law is only a provision concerning principles, lackspractical function. It has no detailed regulation about the plaintiff qualification and theproceedings. This paper attempts to give some suggestions about of the litigation scope,plaintiff qualification and the proceedings, hope to benefit the practice of civilenvironmental public interest litigationThe first chapter mainly uses the legal analysis, use the general theory ofjurisprudence to analyze the foundation of civil environmental public interest litigation. Itincludes the rise, theoretical basis, litigation range of the civil environmental public interestlitigation. The second chapter mainly uses comparative analysis. Combining foreignlegislation, practice experience and the specific conditions of China, the author point theproper plaintiff of civil environmental public interest litigation. On the basis of theprevious two chapters, in the third chapter the author proposes procedure suggestions forour civil environmental public interest litigation.
