Everyone knows about privacy in China, but the legislation of the right of privacy isvery little. Tort Law of PRC, which has come into force on July1,2010, provides the rightof privacy in Article2, Paragraph2, but there is no specific provision on it. Thus, thetheoretic circles and practical circles call for details of privacy to provide a basis for thejudges to judge whether a case is a privacy one. The natural thinking of one thing is athinking of typological, so the best way to understand the right of privacy is to classify it.This article tries to make a comparison between Chinese and American history of privacylegislation and privacy cases from practice, aiming to provide some suggestions for thejudges and give some advice to the coming legislation of the right of privacy.
