This paper focuses on the analysis of Wang abuse case, Wen Ling child abuse case,combined with other abuse cases, the author finds, abuse behavior and intentional injuryare difficult to distinguish. In practice, Distinguishing between these two concepts oftendepends on the behavior of long-term sustainability characteristics to judge thesubjective purpose. Between the non family members, abuse behavior has occurred.Private prosecution rate of child abuse cases is very low. The author thinks, the keys todistinguish abuse and acts of intentional injury are behavior means and behavioralconsequences. Abuse includes acts of intentional injury in means. Acts of abuse, byforce to other body tissues and organs, directly caused light damage or injury, accordingto the crime of intentional injury to punish, other acts of abuse, according to whether avile, are decided whether to follow the crime of abuse punishment. Long-term andconsistency don’t belong to inevitable characteristic of abusive behavior. Abuse thesubject scope of the crime should not be confined to the family members. Tell forms ofcrime of abuse should be composed of private prosecution to the public prosecution.
