With the rising of court cases, the court met a new problem in the process of case-the person subjected to execution with an outsider malicious collusion, false leasecontract to avoid execution.The execution of the false lease contract is different fromgeneral leasing contract, our country law has explicitly stipulated in the contract of leaseof general, and for this kind of false the provisions of the lease contract is not special,just to be generally classified as a breach of the execution behavior and givecorresponding punishment.But, this kind of penalty does not effectively curb false leasecontract to the circumvention of execution.Therefore, this article try to analysis thereason, found the question, and draw lessons from other countries and regions of legalregulation, work out effective legal norm to contain false phenomenon of lease, protectrights and interests of creditors, to perfect our lease contract legal system, strengthenour legal system.If we do this, the legal system construction of our country will becomemore orderly and healthy.
