China’s criminal law provisions did not make a clear regulation for non-classicalproperty violence crime problem.The traditional criminal law theory believe:robbery stresses the two "on the spot" of the crime, that is using violence on the spotand obtaining property on the spot. But, with the appearance of new forms of crime inpractice, some special types of robbery breaks through the content of traditional theory.Namely the case only meet the means on the spot and did not meet the objectivebehavior on the spot. How to determination the nature of this kind of behavior, thetheoretical circle still have controversial. Through the analysis of ma’s robbery behaviorand the combination with German penal code in this article, study the "atypical"property violence crime and eventually come to the conclusion. Hope to provide sometheoretical thinking for the legal boundaries between property crime and how tocorrectly recognized property crime in the judicial practice.
