With the development of technology and the prosperity of information inmodern society, the role of intellectual property became more and more important inmarket economy and social life. Many countries are paying increasingly muchemphasis on intellectual property, one after another to construct and improve thelegal protection system of intellectual property. In addition to the trademark andenterprise name, many business markings are popping up, such as domain name,trade dress, trade name, special marks. And it has important significance forpromoting the comprehensive strength of China and building an innovation-orientedcountry. Therefore, in order to protect the new business marking, to solve variousproblems about legal protection of business mark and to integrate resource in largestdegree, this paper will study business marking as a whole; correctly understand itsvalue in the field of economy.At first, this article starts from topical cases of business marks protection, leadsto the basic concept of business marks, types, function and value, so as to laytheoretical foundation for the next discussion, so that readers may have a directlyidea on it. The second part points out some problems about the legal protectionsystem of business marks, such as confused legislative norm and unified juridicalcriterion, then analyses the defect of the legal protection system of business marksand the conflicts of right caused by imperfect legal system. At the same time, putforward some suggestions to solve the problem of legal protecting system ofbusiness marks,In a word, I hope that though the overall study of business marking; based onthe social environment of the law to analyze the current situation of the protectionfor business marking, and then to explore the reasons behind the phenomenon thatthe defects of legislation and the conflicts of right and so on. Thus get a conclusion that it is urgent to improve the law system of business marking protection in Chinaand puts forward proposals and suggestions on the solution of the problems.
